This Privacy Policy ("Policy") describes how Skul Projects Inc. ("Skul", "we", "us", or "our") collects, uses, discloses, and otherwise processes personal information when you access or use our websites, applications, or services (collectively, the "Services"). Skul Projects Inc. is headquartered in Ontario, Canada, and this Policy has been drafted to comply with the Personal Information Protection and Electronic Documents Act (PIPEDA), applicable provincial privacy laws, and applicable U.S. privacy legislation, including the California Consumer Privacy Act (CCPA) and other similar U.S. state laws.

Note on End Users of Merchant Stores

If you interact with a Skul-powered widget embedded in a third-party storefront (such as on a Shopify site), we collect and process your data on behalf of that merchant. In such cases, Skul acts strictly as a service provider or processor and the merchant is the data controller. Please refer to the respective merchant's privacy policy for details regarding their data practices. Skul does not use this data for independent commercial purposes.

2How We Collect Information

We collect information through:

  • Direct input from you (e.g., form submissions, emails, chats)
  • Automated technologies, including cookies and browser logs
  • Third-party services, such as analytics providers and business partners
  • Employer or organization, if your access is via a company account
  • Integrations with third-party platforms (such as Shopify), where authorized by merchants under applicable platform terms and scopes

3How We Use Personal Information

We use your information to:

  • Operate and improve our Services
  • Authenticate user accounts and secure transactions
  • Provide customer support and respond to inquiries
  • Process payments and issue invoices
  • Send transactional and promotional communications
  • Personalize content and recommendations
  • Monitor compliance with terms of service

Some features of the Services, including the Skul Widget, may incorporate the use of artificial intelligence (AI) and machine learning technologies to analyze behavior, provide product recommendations, and facilitate chat-based support. These AI features are designed to assist users and merchants and are not used to make legally binding or high-risk decisions. Users may reach out at any time to request human intervention or clarification.

We will only use your personal information for the purposes described above unless otherwise permitted or required by law.

4Legal Basis for Processing (For Canadian and EEA Users)

Under PIPEDA, we collect, use, and disclose your personal information with your knowledge and consent, except where otherwise permitted or required by law. You may withdraw your consent at any time, subject to legal or contractual restrictions and reasonable notice.

5How We Share Your Information

We may disclose personal information to:

  • Service providers for hosting, analytics, email, support, and payment processing

Where we access or receive personal data from platform integrations (such as Shopify), we comply with the terms of such platforms and only access data permitted through authorized scopes and merchant instruction.

We never sell your personal information.

We do not sell personal information or knowingly collect information from minors under 16.

This Policy is governed by the laws of the Province of Ontario, and any disputes will be subject to the exclusive jurisdiction of the courts in Toronto, Ontario, Canada.
